This recent and significant update, <strong data-renderer-mark=\"true\">CPRA California Privacy Rights Act, <\/strong>includes new regulations. It has been in effect since January 1, 2023, forcing companies and organizations to prepare their data mechanism to comply with the recent changes.<\/p>\n<h2 id=\"What-are-the-latest-conversions-and-upgrades-in-the-CCPA-for-2023?\" data-renderer-start-pos=\"2069\">What are the latest conversions and upgrades in the CCPA for 2023?<\/h2>\n<p data-renderer-start-pos=\"2140\">On <strong data-renderer-mark=\"true\">November 3, 2020,<\/strong> California voters favored Proposition 24, also known as the <strong data-renderer-mark=\"true\">CPRA. <\/strong>This law provides consumers additional protection and includes a series of efficient privacy rights.\u00a0It is sometimes referred to as \u201cCCPA 2.0.\u201d, but it does not replace CCPA.<\/p>\n<p>[\/vc_column_text][vc_column_text el_class=&#8221;info-box-simple&#8221;]Please don\u2019t confuse CCPA with CPA \u2013 you can find a detailed explanation in our article: <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/privacy-policy-comparison\/\" href=\"https:\/\/actonic.de\/en\/privacy-policy-comparison\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">Data Privacy Laws explained<\/strong><\/a><strong data-renderer-mark=\"true\">.<\/strong>[\/vc_column_text][vc_column_text]<\/p>\n<p data-renderer-start-pos=\"2525\">The CCPA consisted of several rights: the right to know, the right to delete, the right to opt out of a sale, and the right to non-discrimination. However, the <strong data-renderer-mark=\"true\">CPRA <\/strong>added a few alterations and <strong data-renderer-mark=\"true\">new amendments:<\/strong><\/p>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"2737\"><strong data-renderer-mark=\"true\">The right for users to request correct inaccurate PII <\/strong>(personally identifiable information) and SPI (sensitive personal data)<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"2868\"><strong data-renderer-mark=\"true\">The right to limit or disclose SPI<\/strong> \u201csensitive personal information.\u201d\u00a0The SPI includes the following points: biometric and genetic data, social security, driver\u2019s license, passport number, state identification card, passwords, debit and credit card numbers, racial, ethnic origins, or religious details, union membership, and location.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"3208\">The right for California residents to <strong data-renderer-mark=\"true\">opt out of any profiling<\/strong> being shared or sold to third parties. Organizations will also face penalties if they sell and share personal information regarding minors without any parental or guardian consent.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"3456\">The ability to allow consumers to<strong data-renderer-mark=\"true\"> request from businesses<\/strong> \u201clook back\u201d on all the personal data that was gathered, with whom, and how it was shared, dating back to 12 months. This \u201clook back\u201d provision can be provided from January 1, 2022, until the CPRA becomes effective on January 1, 2023.<\/p>\n<\/li>\n<\/ul>\n<h2 id=\"Changes-for-CCPA-in-2023-due-to-CPRA\" data-renderer-start-pos=\"3751\">Changes for CCPA in 2023 due to CPRA<\/h2>\n<p data-renderer-start-pos=\"3789\">It is required under CPRA to retain a minimum amount of data that is only essential for the organization to fulfill its requirements. In addition, businesses should not keep data for longer than necessary; if they do, a justification must be presented, and they must notify the user. The criteria to Comply with CPRA remained almost the same as in CCPA, but with a slight change:<\/p>\n<ol class=\"ak-ol\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"4173\">Businesses should comply if they obtain a revenue of more than $25 million or gain 50% from selling personal data.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"4292\">Businesses should comply if they process data of more than 100,000 users instead of 50,000.<\/p>\n<\/li>\n<\/ol>\n<p data-renderer-start-pos=\"4387\">The <strong data-renderer-mark=\"true\">California Privacy Protection Agency<\/strong> was created to enforce the CPRA starting <strong data-renderer-mark=\"true\">July 1, 2023. <\/strong>It is responsible for raising awareness about data privacy and ensuring that consumers\u2019 rights are protected while implementing penalties on non-compliant entities.<\/p>\n<p data-renderer-start-pos=\"4650\">Suppose you\u2019re a business owner in California.
