It regulates the protection of any personal information related to EU citizens. <strong data-renderer-mark=\"true\">GDPR <\/strong>is based on seven fundamental principles:<\/p>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"1555\">Lawfulness, fairness, and transparency.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1598\">Purpose limitation.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1621\">Data minimization.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1643\">Accuracy.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1656\">Storage limitation.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1679\">\u00a0Integrity and confidentiality<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1714\">\u00a0Accountability.<\/p>\n<\/li>\n<\/ul>\n<p data-renderer-start-pos=\"1734\">In addition, the term <strong data-renderer-mark=\"true\">&#8220;pseudonymized&#8221;<\/strong> is often used in <strong data-renderer-mark=\"true\">GDPR<\/strong>. Pseudonymization is a method incorporated to diminish the possibilities of personal data leading to identifying the natural person they are attributed to. Therefore, organizations that process personal data from EU-based subjects should be <strong data-renderer-mark=\"true\">GDPR-compliant<\/strong>. Or else they can face fines up to \u20ac20 million or 4% of a company&#8217;s annual turnover.<\/p>\n<h2 id=\"CCPA\" data-renderer-start-pos=\"2136\">CCPA<\/h2>\n<p data-renderer-start-pos=\"2142\">The<strong data-renderer-mark=\"true\"> California Consumer Privacy Act<\/strong> was enacted on January 1, 2020, to protect any personal information that could be linked to California residents, whether it&#8217;s a consumer or household. <strong data-renderer-mark=\"true\">CCPA<\/strong> disregards de-identified data (called pseudonymized in GDPR), public information, and aggregate input. The CCPA is based on three principles: transparency, accountability, and control. The most significant difference with GDPR is probably that CCPA applies not only to individual data, but also covers household data.<\/p>\n<p data-renderer-start-pos=\"2654\">Any entity that conducts business in California and meets the following criteria should comply with CCPA:<\/p>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"2764\">Annual revenues of more than $25 million.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"2809\">Data processing of greater than 50,000 users.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"2858\">Gains at least 50% of revenue from selling personal data.<\/p>\n<\/li>\n<\/ul>\n<p data-renderer-start-pos=\"2919\">The <strong data-renderer-mark=\"true\">CCPA<\/strong> fines include: $2500 for unintentional violation and $7,500 for intentional violation.<\/p>\n<p>[\/vc_column_text][vc_column_text el_class=&#8221;info-box-general&#8221;]You can find more details in our former article: <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/ccpa-vs-gdpr-data-privacy-laws-in-europe-and-the-usa\/?utm_referrer=https%3A%2F%2Fwww.google.com%2F&amp;nab=1\" href=\"https:\/\/actonic.de\/en\/ccpa-vs-gdpr-data-privacy-laws-in-europe-and-the-usa\/?utm_referrer=https%3A%2F%2Fwww.google.com%2F&amp;nab=1\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">CCPA vs. GDPR: data privacy laws in Europe and the USA.<\/strong><\/a>[\/vc_column_text][vc_column_text]<\/p>\n<p data-renderer-start-pos=\"3125\">However, since January 2023, there is an extension of the CCPA, namely <strong><a href=\"https:\/\/actonic.de\/en\/significant-changes-to-ccpa-in-2023-an-overview\/\">CPRA, which brings some changes.<\/a><\/strong> For example, the CCPA allows individuals to refuse their personal data to be shared by organizations, whereas CPRA also gives them the right to decide who can sell and collect their data.<\/p>\n<h2 id=\"CPA\" data-renderer-start-pos=\"3474\">CPA<\/h2>\n<p data-renderer-start-pos=\"3479\">The<strong data-renderer-mark=\"true\"> Colorado Privacy Act<\/strong> will operate starting July 1, 2023; it protects the personal information of consumers that are residents of Colorado. Any controller that handles a business in Colorado, whether it&#8217;s selling products or delivering services for its residents, should be compliant with <strong data-renderer-mark=\"true\">CPA<\/strong>. In addition, controllers should satisfy these two requirements:<\/p>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"3844\">Processing data annually of greater than 100,000 consumers.<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"3908\">Obtain revenue or discounts from selling data of 25,000 consumers.<\/p>\n<\/li>\n<\/ul>\n<p data-renderer-start-pos=\"3979\">So far, no penalties are set yet, so a breach of <strong data-renderer-mark=\"true\">CPA<\/strong> is regarded as a deceptive trade practice.<\/p>\n<h3 id=\"VCDPA\" data-renderer-start-pos=\"4077\">VCDPA<\/h3>\n<p data-renderer-start-pos=\"4084\">The <strong data-renderer-mark=\"true\">VCDPA <\/strong>(Virginia Consumer Data Protection Act) acts similarly to the previous laws mentioned above. It provides consumers the right to access their personal data and request businesses to delete their information, excluding de-identified data or publicly available information. This act won&#8217;t be enforced until January 1, 2023; entities operating businesses in Virginia should ensure their companies fully comply with <strong data-renderer-mark=\"true\">VCDPA<\/strong> to avoid <strong data-renderer-mark=\"true\">penalties<\/strong>. Any organization violating this act will face up to $7500 fines plus attorney fees.<\/p>\n<p data-renderer-start-pos=\"4616\">Make sure to<strong data-renderer-mark=\"true\"> research privacy data laws<\/strong> in your area that apply to your company&#8217;s thresholds.
