But what exactly does that mean? Order processing comes into play whenever a company is commissioned to process personal data. The commissioned company then acts as a processor, which according to Art. 4, No. 7 can be both natural and legal persons or authorities.<\/p>\n<p data-renderer-start-pos=\"1575\"><strong data-renderer-mark=\"true\">Examples of order processing:<\/strong><\/p>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"1608\">External payroll<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1628\">Remote maintenance or external IT support<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1673\">Cloud <span id=\"a6b030b0-0cb8-4535-9a90-b49767f9f7bf\" data-renderer-mark=\"true\" data-mark-type=\"annotation\" data-mark-annotation-type=\"inlineComment\" data-id=\"a6b030b0-0cb8-4535-9a90-b49767f9f7bf\">provider<\/span>s<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1692\">Web hosts<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1705\">External accounting<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"1728\">Call center for customer calls<\/p>\n<\/li>\n<\/ul>\n<p data-renderer-start-pos=\"1762\">As soon as there is an order processing relationship according to Art. 28 and external service providers have the opportunity to access personal data, a legal basis must be created. By means of a contract between the person responsible and the processor, the corresponding legal framework conditions are laid down, which must be observed when handling this personal data. The data processing agreement (DPA) defines, among other things, the rights and obligations of both parties, and the purpose of data processing.<\/p>\n<h2 id=\"What-must-be-included-in-a-DPA?\" data-renderer-start-pos=\"2280\">What must be included in a DPA?<\/h2>\n<p data-renderer-start-pos=\"2313\">It is important that a data processing agreement is concluded before the actual order processing to fulfil all legal bases. Since the responsibilities must be clearly defined in the event of a conflict between the parties, it is important to draw up a DPA in a correspondingly clear and legally compliant manner.<\/p>\n<p data-renderer-start-pos=\"2627\"><strong data-renderer-mark=\"true\"><span id=\"bc94ff78-77c7-4691-aeb8-e5ade13bf9bc\" data-renderer-mark=\"true\" data-mark-type=\"annotation\" data-mark-annotation-type=\"inlineComment\" data-id=\"bc94ff78-77c7-4691-aeb8-e5ade13bf9bc\">What must be included in a DPA according to GDPR article 28: <\/span><\/strong><\/p>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"2692\">Subject of the processing order (description of the activity of the processor)<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"2774\">Purpose of the processing (admissibility of the intended data processing)<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"2851\">Rights and obligations of the contractor\/client<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"2902\">Duration of the contract<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"2930\">Confidentiality obligation (compliance with confidentiality when processing data)<\/p>\n<\/li>\n<\/ul>\n<p data-renderer-start-pos=\"3015\">After the processing has been specified in writing or electronically, the client must regularly check compliance with the order processing contract and takes responsibility for compliance with data protection regulations.
