A solid understanding of <strong data-renderer-mark=\"true\">LGDP is a must for any business with Brazilian clients, customers, partners. <\/strong>The maximum penalty for leaking personal data is R$ 50 million or up to 2 percent of the organization\u2019s annual revenue.<\/p>\n<p data-renderer-start-pos=\"2605\">We&#8217;ll look at the law a little deeper below. Let\u2019s start:<\/p>\n<h2 id=\"Who-does-the-LGPD-apply-to?\" data-renderer-start-pos=\"2664\">Who does the LGPD apply to?<\/h2>\n<p data-renderer-start-pos=\"2693\"><strong data-renderer-mark=\"true\">The LGPD applies to organizations worldwide that have any connection with people in Brazil. <\/strong>Whether it&#8217;s customers, employees, business partners, or contractors. International privacy laws often share the characteristic of including an extraterritoriality element, just like <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-gdpr\/\" href=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-gdpr\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">GDPR <\/strong><\/a>or <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/how-to-comply-with-ccpa-the-ultimate-guide-for-2023\/\" href=\"https:\/\/actonic.de\/en\/how-to-comply-with-ccpa-the-ultimate-guide-for-2023\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">CCPA<\/strong><\/a> do.<\/p>\n<p data-renderer-start-pos=\"2987\">If a company directly or indirectly deals with <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-personally-identifiable-information-pii\/\" href=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-personally-identifiable-information-pii\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">Personally Identifiable Information (PII) <\/strong><\/a>from people outside it, then the control and management of that data must fully comply with the law.<\/p>\n<p data-renderer-start-pos=\"3178\">By external persons, we include all stakeholders that a company may have, such as: customers, suppliers, visitors, service providers, leaders, etc. Since every company deals with data from outsiders, it can be said that the requirements of this law cover<strong data-renderer-mark=\"true\"> every company.<\/strong> LGPD is not limited to businesses of a particular size or turnover.<\/p>\n<h2 id=\"The-LGDP-will-cover-you-or-your-organization-if-it\u2019s:\" data-renderer-start-pos=\"3520\">The LGDP will cover you or your organization if it\u2019s:<\/h2>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"3577\">Processing personal data in Brazil, or data that was collected in Brazil<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"3653\">Processing the personal data of people in Brazil, or<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"3709\">Offering goods or services to Brazilian clients and consumers<\/p>\n<\/li>\n<\/ul>\n<h2 id=\"Exceptions-to-the-LGPD-law:\" data-renderer-start-pos=\"3776\">Exceptions to the LGPD law:<\/h2>\n<p data-renderer-start-pos=\"3806\">LGPD <strong data-renderer-mark=\"true\">does not apply<\/strong> in case when:<\/p>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"3843\">you carried out processing personal data exclusively for <strong data-renderer-mark=\"true\">private, non-profit, journalistic, artistic and\/or academic<\/strong> purposes<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"3972\">the processing of personal data is carried out exclusively for the purpose of <strong data-renderer-mark=\"true\">public and state security<\/strong>, national defense, or investigation and prosecution of crimes<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"4141\">shared with Brazilian data processing agents, is subject to international transfer to a country besides the country of origin, or originates outside of Brazil and is not subject to communication<\/p>\n<\/li>\n<\/ul>\n<h2 id=\"What-are-Brazil's-LGPD-consumer\u2019s-rights?\" data-renderer-start-pos=\"4341\">What are Brazil&#8217;s LGPD consumer\u2019s rights?<\/h2>\n<p data-renderer-start-pos=\"4384\">The LGDP provides <strong data-renderer-mark=\"true\">nine rights<\/strong> for individuals over their personal data.<\/p>\n<p data-renderer-start-pos=\"4457\">The controller protects and facilitates the individual&#8217;s personal data rights.<\/p>\n<h2 id=\"The-nine-'data-subject-rights':\" data-renderer-start-pos=\"4537\">The nine &#8216;data subject rights&#8217;:<\/h2>\n<ol class=\"ak-ol\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"4572\">right of the person to confirm that their personal data is being processed<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"4650\">right of access to personal data<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"4686\">right to correction of incomplete, incorrect or outdated personal data<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"4760\">right to anonymize, block or delete any unnecessary, excessive, or inconsistent personal data<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"4857\">the right to ask the data controller to move their personal data to another service or product provider (data portability)<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"4983\">right to erasure of their personal data (with exceptions, according to Article 16)<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"5069\">right to information about public or private entities with whom their personal data is shared, as well as why it is shared<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"5195\">right to provide information about own rights and to refuse to consent to the processing of one&#8217;s personal data and the consequences of refusal<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"5342\">right to revoke the consent to the processing of their personal data<\/p>\n<\/li>\n<\/ol>\n<p data-renderer-start-pos=\"5416\">The European <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-gdpr\/\" href=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-gdpr\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">General Data Protection Regulation GDPR<\/strong><\/a> inspired the origin of <em data-renderer-mark=\"true\">Lei Geral de Prote\u00e7\u00e3o de Dados<\/em>. What the GDPR is to residents of Europe, the LGDP is to residents of Brazil. LGPD is similar to GDPR in many ways, however, there are a few <strong data-renderer-mark=\"true\">differences.<\/strong><\/p>\n<p data-renderer-start-pos=\"5678\">In the following, we will make a short comparison of these two laws, highlighting the key differences between them.<\/p>\n<h2 id=\"LGDP-vs.-GDPR\" data-renderer-start-pos=\"5795\">LGDP vs. GDPR<\/h2>\n<h3 id=\"1.-Who-does-the-law-apply-to?\" data-renderer-start-pos=\"5811\">1. Who does the law apply to?<\/h3>\n<p data-renderer-start-pos=\"5842\"><strong data-renderer-mark=\"true\">LGDP:<\/strong> Residents of Brazil<\/p>\n<p data-renderer-start-pos=\"5869\"><strong data-renderer-mark=\"true\">GDPR<\/strong>: Residents of the EU<\/p>\n<h3 id=\"2.-What-are-the-differences-in-the-legal-basis-for-processing?\" data-renderer-start-pos=\"5896\">2. What are the differences in the legal basis for processing?<\/h3>\n<p data-renderer-start-pos=\"5960\">The LGPD covers some legal bases for processing personal data, which are not covered by GDPR. Among them, we include: credit protection, credit analysis; protection of health; anonymization of personal data (where possible); and exercise of rights in administrative, arbitration, or judicial proceedings.<\/p>\n<h3 id=\"3.-Who-must-comply?\" data-renderer-start-pos=\"6266\">3. Who must comply?<\/h3>\n<p data-renderer-start-pos=\"6287\"><strong data-renderer-mark=\"true\">LGDP: <\/strong>Any organization that processes personal data of Brazilian residents, regardless of its location<\/p>\n<p data-renderer-start-pos=\"6391\"><strong data-renderer-mark=\"true\">GDPR: <\/strong>Any organization that processes personal data of European residents regardless of its location<\/p>\n<h3 id=\"4.-Is-a-DPO-required?\" data-renderer-start-pos=\"6493\">4. What are the penalties?<\/h3>\n<p data-renderer-start-pos=\"6715\"><strong data-renderer-mark=\"true\">LGPD:<\/strong> The greater of 2% of annual revenues or R51 million<\/p>\n<p data-renderer-start-pos=\"6775\"><strong data-renderer-mark=\"true\">GDPR:<\/strong> Up to 4% of annual revenue or up to 20 million euros for violation<\/p>\n<p data-renderer-start-pos=\"6852\">It is characteristic of Brazil that there is no real authority to whom you should report an incident for<strong data-renderer-mark=\"true\"> data breach<\/strong>. Instead, investigations, fines and other punitive measures are initiated by Brazilian agencies that monitor the rights of data subjects. Such is the case with the Ministry of Public Affairs.<\/p>\n<p data-renderer-start-pos=\"7162\">The deadline for reporting the incident is specified as a &#8220;reasonable time&#8221;, unlike the GDPR, where the deadline is set at 72 hours.<\/p>\n<h2 id=\"Does-the-LGPD-apply-to-your-organization?\" data-renderer-start-pos=\"7296\">Does the LGPD apply to your organization?<\/h2>\n<p data-renderer-start-pos=\"7339\">YES! If:<\/p>\n<p data-renderer-start-pos=\"7349\">\u2714\ufe0f Your organization operates in Brazil<\/p>\n<p data-renderer-start-pos=\"7391\">\u2714\ufe0f Your organization operates anywhere in the world, but processes the data of any individual in Brazil<\/p>\n<p data-renderer-start-pos=\"7497\">The degree of application depends on the nature of your business.<\/p>\n<h2 id=\"Bottom-line:\" data-renderer-start-pos=\"7566\">Bottom line:<\/h2>\n<p data-renderer-start-pos=\"7580\">Today, the LGDP is an effective law which prevents the misuse of personal data by regulating how businesses and organizations can collect, use and handle personal data. It increases accountability by supplementing or replacing existing federal sector privacy laws. LGDP also enables the creation of a Data Protection Authority.<\/p>\n<p data-renderer-start-pos=\"7912\">It\u2019s of huge importance for you to evaluate the processing of personal data and determine whether the requirements of the LGPD apply to you.
