It&#8217;s a misconception that can run into money. That&#8217;s why it&#8217;s best to clarify what exactly <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-personally-identifiable-information-pii\/\" href=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-personally-identifiable-information-pii\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">personally identifiable information<\/strong><\/a> is under CCPA\/CPRA.<\/p>\n<p data-renderer-start-pos=\"1714\">According to CCPA <a class=\"css-tgpl01\" title=\"https:\/\/ccpa-info.com\/home\/1798-140-definitions\/#:~:text=(1)%20%22Personal%20information%22,a%20particular%20consumer%20or%20household.\" href=\"https:\/\/ccpa-info.com\/home\/1798-140-definitions\/#:~:text=(1)%20%22Personal%20information%22,a%20particular%20consumer%20or%20household.\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">Article 798.140,<\/strong><\/a> personally identifiable information is information that can be used to identify an individual or their household, such as: Name, email address, date of birth, customer number, log-in data, IP address, cookies, and more. Publicly available information derived from government agencies or records, such as professional licenses and public property records, are not covered by CCPA.<\/p>\n<p>&nbsp;<\/p>\n<h3 id=\"How-can-you-check-whether-you-are-processing-personal-data?\" data-renderer-start-pos=\"2130\">How can you check whether you are processing personal data?<\/h3>\n<p data-renderer-start-pos=\"2191\">If you answer \u201cyes\u201d to one or more of the following questions, you should be alert:<\/p>\n<p style=\"padding-left: 40px;\" data-renderer-start-pos=\"2276\">\u2714\ufe0f Do you have contact forms on your website?<\/p>\n<p style=\"padding-left: 40px;\" data-renderer-start-pos=\"2323\">\u2714\ufe0f Do you use commenting systems for posts?<\/p>\n<p style=\"padding-left: 40px;\" data-renderer-start-pos=\"2368\">\u2714\ufe0f Do you use Google Analytics?<\/p>\n<p style=\"padding-left: 40px;\" data-renderer-start-pos=\"2401\">\u2714\ufe0f Do you see login data and their histories in dashboards?<\/p>\n<p data-renderer-start-pos=\"2462\">So, you realize, you&#8217;re a <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/knowledge-base\/data-controller-vs-data-processor-what-is-the-difference\/\" href=\"https:\/\/actonic.de\/en\/knowledge-base\/data-controller-vs-data-processor-what-is-the-difference\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">data processor <\/strong><\/a>faster than you think. Hence, be sure to exercise caution when it comes to CCPA compliance. Because, just as with the <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-gdpr\/\" href=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-gdpr\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">GDPR<\/strong><\/a>, the market location principle applies here. This means that in certain cases, <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/ccpa-and-cpra-why-do-they-even-matter-for-eu-companies\/\" href=\"https:\/\/actonic.de\/en\/ccpa-and-cpra-why-do-they-even-matter-for-eu-companies\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">European companies can also be affected by CCPA.<\/strong><\/a> You don&#8217;t need to have a physical presence in California to do so. In fact, your place of business doesn&#8217;t even have to be in the US.<\/p>\n<p data-renderer-start-pos=\"3095\">Once you run a for-profit business that collects, processes, or sells data from California citizens AND you meet one of the following criteria, you must comply with CCPA\/CPRA:<\/p>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"3274\">Gross annual revenue of more than $25 million<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"3323\">Processing of at least 100,000 consumers data<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"3372\">50% or more of annual profits come from the sale or transfer of personal data<\/p>\n<\/li>\n<\/ul>\n<p data-renderer-start-pos=\"3453\">So, even if you&#8217;re a \u201csmall fish\u201d out there, the rule of thumb is, no one is exempt from CCPA.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"CCPA-Myth-#3:-GDPR-Compliance-guarantees-CCPA-Compliance\" data-renderer-start-pos=\"3549\">CCPA Myth #3: GDPR Compliance guarantees CCPA Compliance<\/h2>\n<p data-renderer-start-pos=\"3607\">Many consider the European <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-gdpr\/\" href=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-gdpr\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">General Data Protection Regulation (GDPR) <\/strong><\/a>to be one of the strictest data protection laws in the world \u2013 there&#8217;s some truth to that. Still, being GDPR-compliant doesn&#8217;t mean your company is automatically CCPA-compliant. That&#8217;s partly because the CCPA definition of personal data is broader than under the GDPR. But don&#8217;t worry, since both laws are still quite similar, you don&#8217;t have to do much further to comply with CCPA if you&#8217;re already compliant with the GDPR.<\/p>\n<p data-renderer-start-pos=\"4101\"><strong data-renderer-mark=\"true\">But there is one thing you definitely need to consider<\/strong>: The <em data-renderer-mark=\"true\">\u201cDo not sell my personal data\u201d<\/em> page. The reason is that with CCPA, the so-called <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-the-ccpa-right-to-opt-out\/\" href=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-the-ccpa-right-to-opt-out\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">right to opt-out <\/strong><\/a>applies. This means that you must allow consumers to prohibit the sale of personal data to third parties. And this is where the CCPA legislative text is particularly specific. Namely, this must take place via a separate page with the <strong data-renderer-mark=\"true\">mandatory heading,<\/strong> <em data-renderer-mark=\"true\">\u201cDo not sell my personal information.\u201d<\/em> On this page, the request to opt-out must be made as simple as possible.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"CCPA-Myth-#4:-CCPA-does-not-apply-to-employees\" data-renderer-start-pos=\"4625\">CCPA Myth #4: CCPA does not apply to employees<\/h2>\n<p data-renderer-start-pos=\"4673\"><strong data-renderer-mark=\"true\">Alarm! Danger! Banish this myth from your mind as soon as possible!<\/strong><\/p>\n<p data-renderer-start-pos=\"4742\">This may have been true for a while, but since the January 2023 <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/significant-changes-to-ccpa-in-2023-an-overview\/\" href=\"https:\/\/actonic.de\/en\/significant-changes-to-ccpa-in-2023-an-overview\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">amendment to the CCPA by CPRA, <\/strong><\/a>the exception regarding employees has been removed. Since the CPRA went into effect, <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-protection\/\" href=\"https:\/\/actonic.de\/en\/knowledge-base\/what-is-protection\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">data protection<\/strong><\/a> applies to all consumers, and that term now includes employees and even freelancers or job applicants. If you are an <strong data-renderer-mark=\"true\">employer located in California,<\/strong> you must provide your employees with the common CCPA rights now as well. Thus, your employees also have the right to see an updated privacy policy that explains exactly how their data is collected. Also consider the right to know\/disclosure: Your employees must be informed of the purpose and duration of data retention BEFORE it occurs.<\/p>\n<p data-renderer-start-pos=\"5427\">If you use <strong data-renderer-mark=\"true\">Jira and Confluence <\/strong>in your organization and want to make them CCPA-compliant, take a look at this helpful article: <a class=\"css-tgpl01\" title=\"https:\/\/actonic.de\/en\/how-to-comply-with-the-ccpa-right-to-know\/\" href=\"https:\/\/actonic.de\/en\/how-to-comply-with-the-ccpa-right-to-know\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">How to comply with the CCPA Right to Know in Jira.<\/strong><\/a><\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"CCPA-Myth-#5:-For-compliance,-the-ability-to-opt-out-is-sufficient;-an-opt-in-right-does-not-need-to-be-granted\" data-renderer-start-pos=\"5606\">CCPA Myth #5: For compliance, the ability to opt-out is sufficient; an opt-in right does not need to be granted<\/h2>\n<p data-renderer-start-pos=\"5719\">Unfortunately, no.<\/p>\n<p data-renderer-start-pos=\"5739\">This assumption is not true for all audiences. Because there is a special feature under CCPA: if data is collected and sold from consumers who are<strong data-renderer-mark=\"true\"> under 16 years old, <\/strong>opt-in consent must be obtained. And for <strong data-renderer-mark=\"true\">children under 13,<\/strong> consent must even be obtained from a parent or guardian. If their permission is not granted, your company must wait 12 months before asking for consent again.<\/p>\n<p data-renderer-start-pos=\"6127\">According to the text of the law, this obligation only applies to a company if it has \u201cactual knowledge\u201d of the child&#8217;s age. Don&#8217;t speculate on this passage, however. Ignorance does not protect against punishment. The penalties for breaches of children&#8217;s personal information are higher than other penalties, up to <strong data-renderer-mark=\"true\">$7,500 for each breach.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"CCPA-Myth-#6:-Nonprofits-are-off-the-hook\" data-renderer-start-pos=\"6467\">CCPA Myth #6: Nonprofits are off the hook<\/h2>\n<p data-renderer-start-pos=\"6510\">A closer read should be made on this myth as well. That&#8217;s because <a class=\"css-tgpl01\" title=\"https:\/\/ccpa-info.com\/home\/1798-140-definitions\/\" href=\"https:\/\/ccpa-info.com\/home\/1798-140-definitions\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\">CCPA Section 1798.140 (c) (2)<\/strong><\/a> defines what exactly \u201cbusinesses\u201d are that must comply with CCPA. Here it describes that nonprofit entities can also be affected if the <strong data-renderer-mark=\"true\">following scenarios apply to them:<\/strong><\/p>\n<ul class=\"ak-ul\" data-indent-level=\"1\">\n<li>\n<p data-renderer-start-pos=\"6780\">You are a nonprofit business organization, and you own a for-profit subsidiary<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"6862\">You are a nonprofit business with commercial operations<\/p>\n<\/li>\n<li>\n<p data-renderer-start-pos=\"6921\">You are a nonprofit business that enters into a cooperative arrangement with a company that is covered by CCPA\/CPRA<\/p>\n<\/li>\n<\/ul>\n<p data-renderer-start-pos=\"7040\">In other words, you&#8217;d better read up on whether your nonprofit should be CCPA-compliant before risking hefty penalties.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"CCPA-Myth-#7:-I-don't-need-tools-to-help-me-comply-with-the-CCPA\" data-renderer-start-pos=\"7161\">CCPA Myth #7: I don&#8217;t need tools to help me comply with the CCPA<\/h2>\n<p data-renderer-start-pos=\"7227\">Under<a class=\"css-tgpl01\" title=\"https:\/\/ccpa-info.com\/home\/1798-105-consumers-right-to-deletion\/\" href=\"https:\/\/ccpa-info.com\/home\/1798-105-consumers-right-to-deletion\/\" data-renderer-mark=\"true\"><strong data-renderer-mark=\"true\"> CPRA Section 1798.105,<\/strong><\/a> consumers have the right to make a <strong data-renderer-mark=\"true\">request for the deletion<\/strong> of personal information. A <strong data-renderer-mark=\"true\">right to request correction <\/strong>of the data is also available to consumers. As a business, you must follow up on these requests within 45 calendar days. Hence, you should have a tool that allows you to quickly and easily search, modify and, if necessary, clean up data.<\/p>\n<p data-renderer-start-pos=\"7610\">Let&#8217;s say an employee leaves your company and asks you to delete data.
